HowPopular.com "First To X" Giveaway - Official Rules

  1. ENTRY: No purchase necessary to enter or win. To enter the "First to X" Giveaway ", you must use the website invite flow to invite friends and gain votes.
  2. ELIGIBILITY: This giveaway is open only to legal U.S. residents, over the age of 18. Employees and their families of HowPopular.com (along with its contractors, affiliates and subsidiaries) may participate, but are not eligible to win prizes. Void where prohibited by law. Contestants residing in those areas where the giveaway is void may participate in the giveaway but may not win any prizes.
  3. WINNER SELECTION AND ODDS: At its sole discretion, HowPopular.com will determine the winners based on the first person to reach the minimum threshold to win each prize.Winning odds are based on the number of total entries. Employees of HowPopular.com will judge this selection. All decisions of the judges are final.
  4. PRIZES: The winner in each category will receive the prize as outlined on the home page of the site. Prize details and availability are subject to change, in which case a prize of equal or greater value will be substituted at HowPopular.com's sole discretion. Prizes are non-transferable. Except as set forth above, no substitutions will be awarded except at our sole discretion, in which case a prize of equal or greater value will be awarded. All federal, state and local taxes are the responsibility of the winner.
  5. WINNER NOTIFICATION: The winner will be notified within 14 days after the determination date. Inability to contact a winner may result in disqualification and selection of an alternate winner.
  6. RELEASE: By receipt or use of any prize, winner agrees to release and hold harmless HowPopular.com and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the giveaway or receipt or use or misuse of any prize.
  7. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in internet lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the giveaway; (4) technical or human error which may occur in the administration of the giveaway or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the giveaway or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, HowPopular.com reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
  8. GENERAL CONDITIONS: The winner may be required to execute and return a Certificate of Eligibility, Consent and General Release form within 14 days of notification. The winner may also be required to complete and return a W-9 for tax purposes. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Any income tax liability is the sole responsibility of the winner.

    By acceptance of the prize, the winner consents to the use of his or her name and/or likeness for purposes of advertising or trade without further compensation, unless prohibited by law.

HowPopular.com reserves the right to cancel, suspend and/or modify the giveaway, or any part of it, if any fraud, technical failures or any other factor beyond our reasonable control impairs the integrity or proper functioning of the giveaway, as determined by HowPopular.com in its sole discretion. HowPopular.com reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the giveaway or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the giveaway may be a violation of criminal and civil law, and, should such an attempt be made, HowPopular.com reserves the right to seek damages from any such person to the fullest extent permitted by law. HowPopular.com's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
